Wal-Mart Driver Indicted on 10 Counts in Tracy Morgan Crash
The driver of a Wal-Mart truck involved in a crash that injured comedian Tracy Morgan and three others and killed comedian James McNair has been indicted on 10 charges by a New Jersey grand jury.
Kevin Roper was charged Dec. 23 with first-degree aggravated manslaughter, second-degree vehicular homicide and third-degree aggravated assault stemming from the 2014 crash.
Roper was driving the Wal-Mart truck that crashed into a limousineÌýon the New Jersey Turnpike in June 2014.ÌýA National Transportation Safety Board investigation stated in August that Roper hadn't slept during the previous 28 hours before the crash and thatÌýhe failed to slow down immediately before the crash, despite posted warning signs on the turnpike.

Morgan and Wal-Mart have reached an undisclosed settlement, and Morgan has said that Wal-Mart "did right by me and my family."
Roper's attorney, David Glassman,Ìýargued that Roper's chance for a fair trial has been harmed by the publicity generatedÌýby Wal-Mart's settlement of Morgan's lawsuit.ÌýGlassman failed in his efforts to have previous charges of vehicular homicide and assault by auto thrown out.
An arraignment will be scheduled at a later date.
